General Terms and Conditions (GTC) Webshop Trouvaille kids & living ( http://www.trouvaillekids.ch )


1. Validity of the General Terms and Conditions
These general terms and conditions (hereinafter referred to as T&Cs) govern the relationship between Trouvaille kids GmbH (hereinafter referred to as Trouvaille kids & living) and the customer (hereinafter referred to as customer). These T&Cs are part of every contract between Trouvaille kids & living and the customer. Trouvaille kids & living operates an online shop on its website and also sells its goods in the store at Thunstrasse 21 and Luisenstrasse 16, 3005 Bern. The deliveries and services of this online shop are provided exclusively under the conditions of these general terms and conditions in the version valid at the time of conclusion of the contract. Trouvaille kids does not recognize any deviating conditions of the customer unless Trouvaille kids expressly agrees to them in writing.

2. Order and conclusion of contract
The order is binding for the customer. The order is placed in writing by purchasing online at http://www.trouvaillekids.ch and confirming the terms and conditions upon purchase.
The offers from Trouvaille kids & living on the website are non-binding and subject to change. Trouvaille kids & living is therefore not obliged to provide the service if the item is not available. A contract is concluded between the customer and Trouvaille kids & living as soon as Trouvaille kids & living confirms the customer's order in writing by email (order confirmation). The web shop is updated regularly. It is possible that an item is no longer available at the time of the order. Trouvaille kids & living processes orders within 48 hours and informs the customer whether the desired item is available.

3. Prices
Prices are in CHF (Swiss francs) including statutory VAT. Packaging and shipping costs are not included in the item price and are charged separately (see No. 5). We reserve the right to make price errors and changes.

4. Means of payment
All items are payable in advance (bank transfer), cash on collection or via Twint, Postfinance Card or Visa/Mastercard, unless otherwise agreed. The ordered goods will only be dispatched after the amount has been credited to the Trouvaille kids & living account. If payment is made in advance, the invoice must be paid within 5 working days. Trouvaille kids & living will issue the customer with an invoice for the ordered goods, which will be given to the customer upon delivery of the goods.

In case of advance payment, bank transfers must be made within 5 days to the following account:

If payment is not made within the deadline, Trouvaille kids & living reserves the right to issue a reminder plus a fee of CHF 10.00 and to take legal action.

Payment for furniture orders (only applies to furniture made to order):
Up to CHF 2,000.- payment of 100% upon order. From CHF 2,000.- payment of 75% upon order and 25% upon delivery. In the event of late payment, standard bank interest may be charged.

5. Shipping costs
A flat shipping fee of CHF 9.90 applies for each delivery. We offer free shipping for orders over CHF 100.00. Different shipping costs apply for the shipping of furniture, which can be requested by email. Shipping abroad on request.

6. Delivery
Delivery is made by B-Post to Switzerland and the Principality of Liechtenstein, within 5-10 working days after receipt of payment.

6a. Additional provisions for the delivery of furniture:
For furniture orders, the delivery time is 2-12 weeks, depending on the supplier. We are also happy to arrange for the delivery and assembly of the furniture to you. Delivery and assembly of the furniture are charged according to the effort involved. We would be happy to provide you with an offer for the actual delivery and assembly costs. Please note that Trouvaille kids & living only provides a guarantee on the assembled piece of furniture as long as it was carried out by Trouvaille kids & living or by the company commissioned by us.

7. Collection
The ordered goods can be picked up at the Trouvaille kids & living store at Thunstrasse 21, 3005 Bern. Please make an appointment with us.

8. Retention of title
Trouvaille kids & living remains the owner of the delivered goods until full payment has been made.

9. Delivery times
The customer's order will be processed immediately after receipt of payment. The delivery time depends on availability and stock and is normally 3-5 working days within Switzerland, without assuming any liability for this. Trouvaille kids & living accepts no liability for delivery delays caused by our shipping partners.
If delivery times are longer, the customer will be notified via email. For urgent orders, we recommend purchasing the items directly from Trouvaille kids & living, Thunstrasse 21 / Luisenstrasse 16, 3005 Bern. You can find the opening times on our website under "Our stores".
When ordering furniture, a delivery period of 2-16 weeks from the order date applies, unless the item is in stock.

10. Refusal of acceptance
The costs of an unjustified refusal to accept the delivered goods will be charged to the customer. The provider's right to fulfill the purchase contract remains unaffected.

11. Right of return
The customer can revoke his contract declaration within 5 days without giving reasons in writing by email or by returning the goods. The period begins upon receipt of the goods and these instructions. To meet the deadline, it is sufficient to send the goods or the return request in good time. The customer bears the costs of the return. The return or the return request must be sent to:

In principle, the following items are not eligible for return:
- Products used
- Opened products
- Contaminated products
- All products of the furniture ranges

- Mattresses

No right of return for furniture orders and mattresses.

Specially marked products, display items or those with a reduced price are excluded from the right of return in accordance with section 11. The right of withdrawal for telephone purchases applies exclusively within the framework of Art. 40a ff. OR, but does not establish any further rights.

Return consequences:
In the event of an effective return, the services received by both parties must be returned. The customer is obliged to return the goods undamaged, in perfect condition and in the original packaging. If the goods deteriorate, Trouvaille kids & living can demand compensation from the customer. The customer can avoid the obligation to pay compensation by not using the goods as an owner and refraining from doing anything that could impair their value.

12. Complaints, defects and transport damage, liability
The customer is obliged to inspect the goods immediately after delivery for damage and defects. Possible damage must be reported to the deliverer immediately and noted on the freight or delivery documents. Transport damage and defects must be reported to Trouvaille kids & living immediately, but no later than 5 days after receipt of the goods, in writing and with a photo. The cost of return shipment is borne by the customer.
Trouvaille kids & living assumes no liability for damage caused by improper use of the purchased items.

13. Data protection (-> see also privacy policy and imprint)
The customer's personal data is treated as strictly confidential. The relevant data is used for the execution of the contract between Trouvaille kids and the customer, as well as processed and used for the purposes of future customer support and customer care. No data is passed on to third parties.

14. Applicable law, place of jurisdiction
Swiss law applies to the terms and conditions and the entire legal relationship between Trouvaille kids and the buyer. The place of jurisdiction for all disputes arising from the contractual relationship is Bern.
